This article has been written with the express permission of the mother based on the information that is currently available. This is an ongoing case.
Now, for a little background on this case. It involves a single mother of two girls, aged 8 and 13, who works two jobs, 7 days per week, in order to support her family. When the children are not in school, they are placed with a county Social Service-approved, vetted and background-checked, child care provider. The children attend schools in the Cairo/Durham N.Y. school district.
The first case: the 8-year-old, to be known here as child (A). Over the course of the past few months, child (A) has been having difficulty concentrating on her school work, has been lashing out at others, and has suffered from severe emotional distress. She would not tell her mother what was wrong, but did reveal it to her child care provider. Apparently, several times over the course of this school year, child (A) has been forced into a school bathroom during recess by a fellow female student and made to perform oral sex on said student.
Upon this information being reported to school officials, the New York State police were called as well as the department of Social Services. As an investigation ensued, it was revealed that the other student has had problems in the past and could possibly face actions including removal from school. The mother of child (A), not wanting a permanent stain on the student’s record, opted for probation and no further contact with her child.
As it stands now, both children are still in the same class and the mother of child (A) has not to this date received any copies of the incident report from Cairo Elementary School or the investigating authorities. No disciplinary action has been taken at this point against the person or persons responsible for the care and SAFETY of these children at Cairo Elementary School during recess.
For the next case, child (B), a 13-year-old with a clean record, just trying to fit in and be socially accepted. She made a stupid mistake, which she took full responsibility for. She recently brought three Jell-O shots (small containers of Jell-O made with alcohol) to school to share with her friends. Upon one of the friends being caught with the substance, she revealed the other three and implicated child (B) as the person who provided it.
When all was said and done, the three friends were given three days of out-of-school suspension, and child (B) was given five days of out-of-school suspension pending a superintendent’s hearing.
When the hearing was held, child (B) and her mother appeared. Cairo-Durham Middle School was represented by the superintendent, the principal, and the school attorney. In the mother’s own words to me, she felt very “intimidated”. The school decided that child (B) is to remain on out-of-school suspension until January 5th of 2015 and is not allowed on school property without express written permission and supervision. In addition, the mother has been ORDERED by the school to place child (B) into an intensive drug and alcohol abuse program before child (B) will be allowed to return to school.
The entire proceeding was tape-recorded except for when the mother was told that the Cairo-Durham Central School District may place a permanent stain on child (B)’s school record, which could come back and haunt her later in life when seeking employment or military service, if she were not to comply with the demands.
As these two cases are going on at the same time, it appalls me that the first case isn’t going far enough–to hold all involved responsible–and the second case is going so far overboard that it borders on a violation of parental rights, as well as an attempt to destroy the life of a young girl whom the Cairo/Durham school system claims it holds in such high regard.
As of this date, no judge or court of law has been involved in these proceedings, but it has not been ruled out.
